Monitoring[1]: attention is paid to the prohibition of violence against children

It should be noted that the monitoring of the implementation progress of the National Action Plan to implement the recommendations of the UN Committee against Torture for 2019-2022 in the interval of 2019-2020 was prepared by the Executive Office of the President of the Republic of Tajikistan and the Civil Society Coalition against Torture and Impunity in Tajikistan. Its objective is to guide the implementation of legislation and law enforcement practices and freedom from torture, based on international standards of the right to freedom from torture.

According to this monitoring report, concerning subparagraphs 1 and 2 of paragraph 18 of the plan, which covers improvement of the legislation on the direct prohibition of violence against children, provides organization and holding of awareness-raising activities in educational institutions and other institutions for children, the General Prosecutor’s Office reports that the elaboration of draft laws on making changes and additions to the Criminal Code and Criminal Procedural Code of the Republic of Tajikistan is considered in this direction.

- It should be noted that the implementation of the Law “On parents' responsibility for their children's education and upbringing” is monitored daily, and the prosecutorial authorities have completed specific work based on an action plan. In particular, during the period under analysis, regular meetings and discussions were held to explain the essence and the content of the Law, its role in the education and upbringing of the younger generation, and the responsibilities of parents, surrogate parents, teachers and other responsible institutions and organizations, and there are media broadcasts and discussions. Regardless of parents and teachers' failure to fulfil their responsibilities for the education and upbringing of minors during 2019 in 11 cases and 2020 in 12 cases, criminal cases were instituted under Article 174 of the Criminal Code of the Republic of Tajikistan.

Monitoring the implementation of “National Plan for the implementation of the recommendations of the UN Committee against Torture for 2019-2022” in the interval of 2019-2020 has been prepared jointly by the Executive Office of the President of the Republic of Tajikistan and the Civil Society Coalition Against Torture and Impunity in Tajikistan.

How can the situation be improved? The only recommendation is - DO NOT KEEP SILENT!

Victims and their relatives - not to tolerate violence and inhuman treatment, make such cases public to protect their dignity.

Journalists and human rights defenders (CS) - provide professional assistance to victims, talk about problems.

The stateimpose a total ban on torture and the obligation to monitor and punish the perpetrators.
