Monitoring[1]: ensuring guarantees of the rights of military servicemen
It should be noted that the monitoring of the implementation progress of the National Action Plan to implement the recommendations of the UN Committee against Torture for 2019-2022 in the interval of 2019-2020 was prepared by the Executive Office of the President of the Republic of Tajikistan and the Civil Society Coalition against Torture and Impunity in Tajikistan. Its objective is to guide the implementation of legislation and law enforcement practices and freedom from torture, based on international standards of the right to freedom from torture.
According to the monitoring report, to implement subparagraphs 1 and 3 of paragraph 19 of the plan, the Ministry of Defense to improve the professional skills of military personnel on torture and inhuman treatment carries out public, professional and special training on human rights and freedoms, prevention of hazing among military personnel, the commission of such acts and their consequences, and compliance and legal guarantees for military personnel is under constant review. Also, in units and subunits of the Ministry, when providing legal information to military personnel, the requirements of the relevant articles of the Criminal Code of the Republic of Tajikistan on non-statutory relations are brought to their attention.
- In the military units of the Ministry, unit, platoon and company commanders and military medical staff examine the bodies of soldiers based on a daily schedule; the results are entered in the register of soldier body examinations. Body examinations are also conducted regularly by the leadership and relevant departments of the ministry, the Chief Military Prosecutor's Office, and military prosecutor's offices in military garrisons. Talks, meetings and awareness-raising events involving law enforcement personnel and representatives of the country's intellectuals are regularly held to prevent hazing among service members. During the military conscription period and before the call-up of citizens for military service, an educational company is created by order of commanders, where recruits are taught before taking the military oath and at the same time a separate place is prepared for them to sleep," the report says.
Monitoring the implementation of “National Plan for the implementation of the recommendations of the UN Committee against Torture for 2019-2022” in the interval of 2019-2020 has been prepared jointly by the Executive Office of the President of the Republic of Tajikistan and the Civil Society Coalition Against Torture and Impunity in Tajikistan.
How can the situation be improved? The only recommendation is - DO NOT KEEP SILENT!
Victims and their relatives - not to tolerate violence and inhuman treatment, make such cases public to protect their dignity.
Journalists and human rights defenders (CS) - provide professional assistance to victims, talk about problems.
The state – impose a total ban on torture and the obligation to monitor and punish the perpetrators.
