It should be noted that the monitoring of the implementation progress of the National Action Plan to implement the recommendations of the UN Committee against Torture for 2019-2022 in the interval of 2019-2020 was prepared by the Executive Office of the President of the Republic of Tajikistan and the Civil Society Coalition against Torture and Impunity in Tajikistan. Its objective is to guide the efforts to implement legislation and law enforcement practices and freedom from torture, based on international standards of the right to freedom from torture.

According to the monitoring report, concerning sub-paragraph 7 of paragraph 8 of the plan, based on the statistical data, in 2019, 58 and 2020, 62 convicts died from various diseases, including heart attack, pulmonary tuberculosis, HIV, COVID-19 and other diseases in the penitentiary institutions of the Main Department of Criminal Sanctions. The analysis revealed that most deceased inmates had been suffering from various diseases before their incarceration, and their diseases had progressed during their imprisonment, which, in some cases, led to their death.

- The procedure for registration of deaths among convicts in correctional institutions is carried out following the requirements of the Code of Execution of Criminal Sanctions of the Republic of Tajikistan and the "Procedure for organizing medical care for persons serving sentences in places of detention and custody", approved by joint order of the Ministry of Health and Social Protection and the Ministry of Justice on May 1, 2018, No.40/402. For each case of death among convicts, the prosecutor's office takes timely procedural measures to establish the causes of death.

To implement paragraph 9 of the plan, the Judicial Training Center of the Supreme Court engaged 176 judges and 58 assistant judges in a seminar on "Application of national legislation on torture crimes." In addition, in 2020, the Judge Training Center of the Supreme Court included the topic "Application of National Laws on Torture Crimes," and 162 judges attended training seminars in this field. With support from the Organization for Security and Cooperation in Europe (OSCE) Programme Office in Dushanbe, 43 judges and three members of the Judge Training Centre received training seminars on the principle of effective investigation, inquiry and documentation of torture cases and other forms of cruel treatment and punishment following the standards of the Istanbul Protocol.- Given the importance of combating torture, the decision of the Plenum of the Supreme Court dated 25 June 2012, No. 1 "On the application of criminal law provisions to combat torture" is in force, which provides courts with guidelines for the correct application of legislation on torture, - the report says.

Monitoring the implementation of “National Plan for the implementation of the recommendations of the UN Committee against Torture for 2019-2022” in the interval of 2019-2020 has been prepared jointly by the Executive Office of the President of the Republic of Tajikistan and the Civil Society Coalition Against Torture and Impunity in Tajikistan.

How can the situation be improved? The only recommendation is - DO NOT KEEP SILENT!

Victims and their relatives - not to tolerate violence and inhuman treatment, make such cases public to protect their dignity.

Journalists and human rights defenders (CS) - provide professional assistance to victims, talk about problems.

The stateimpose a total ban on torture and the obligation to monitor and punish the perpetrators.
