Monitoring[1]: records of complaints of torture are kept

It should be noted that the monitoring of the implementation progress of the National Action Plan to implement the recommendations of the UN Committee against Torture for 2019-2022 in the interval of 2019-2020 was prepared by the Executive Office of the President of the Republic of Tajikistan and the Civil Society Coalition against Torture and Impunity in Tajikistan. Its purpose is to guide the implementation of legislation and law enforcement practices and freedom from torture, based on international standards of the right to freedom from torture.

According to the monitoring report, to implement paragraph 14 of the plan, the General Prosecutor's Office reported that according to the state statistical reporting on the activities of prosecutors (form "P"), a quarterly statistical record of complaints on torture is maintained.

- In November 2020, a draft Law of the Republic of Tajikistan, "On Amendments and Additions to the Criminal Procedure Code of the Republic of Tajikistan", was developed. The draft law provides that the administration of detention facilities should immediately send complaints about torture and other forms of cruel, inhuman and degrading treatment and punishment, as well as about the actions and decisions of the bodies of inquiry and investigators, to the criminal justice authorities for consideration", the report states.

Paragraph 15 of the plan is being implemented. Within its framework, JSC "Sanoatsoz" under the Architecture and Construction Committee under the Government of the Republic of Tajikistan in cooperation with representatives of the Directorate of Government Buildings under the Executive Office of the President of the Republic of Tajikistan and the Main Criminal Sanctions Department has developed the design of pre-trial detention centre No.1 and the facility for the execution of punishment for prisoners with the special regime and lifetime prisoners in Rudaki district and the construction works are being conducted. The design for constructing an institution for the execution of sentences for prisoners with a special regime of detention and life prisoners considers their involvement in labour activity. Conditions of serving a sentence for life convicts, as a rule, are envisaged in correctional colonies with a special regime.

- To improve the legislation in the field of execution of criminal punishments and to bring its norms in line with modern requirements, the Ministry developed a new version Code of Criminal Execution of the Republic of Tajikistan, agreed with ministries and agencies and submitted it to the Government of the Republic of Tajikistan for consideration, the report says.

Monitoring the implementation of “National Plan for the implementation of the recommendations of the UN Committee against Torture for 2019-2022” in the interval of 2019-2020 has been prepared jointly by the Executive Office of the President of the Republic of Tajikistan and the Civil Society Coalition Against Torture and Impunity in Tajikistan.

How can the situation be improved? The only recommendation is - DO NOT KEEP SILENT!

Victims and their relatives - not to tolerate violence and inhuman treatment, make such cases public to protect their dignity.

Journalists and human rights defenders (CS) - provide professional assistance to victims, talk about problems.

The state – impose a total ban on torture and the obligation to monitor and punish the perpetrators.
