Monitoring[1]: underage convicts are provided with a psychologist

It should be noted that the monitoring of the implementation progress of the National Action Plan to implement the recommendations of the UN Committee against Torture for 2019-2022 in the interval of 2019-2020 was prepared by the Executive Office of the President of the Republic of Tajikistan and the Civil Society Coalition against Torture and Impunity in Tajikistan.  Its objective is to guide the implementation of legislation and law enforcement practices and freedom from torture, based on international standards of the right to freedom from torture.

To implement paragraph 16, subparagraphs 1, 2, 3, 4 and 6 of the plan, the Ministry has carried out certain activities. Including monitoring of an analysis of the implementation of the Child Justice Reform Program 2017-2021 (in the interval of 2019-2020). On September 21, 2020, a plan of cooperation (activities) in the Republic of Tajikistan was signed between the Ministry of Justice of the Republic of Tajikistan and the UN Children's Fund (UNICEF) office for 2020-2021. Paragraph 6 of this cooperation plan envisages analysis of the juvenile justice legislation to bring in line with the United Nations Standard Minimum Rules for the Administration of Juvenile Justice (Beijing Rules), UN Guidelines for the Prevention of Juvenile Delinquency (Riyadh Guidelines) and Guidelines on Justice in Matters involving child victims and crime witnesses. A national expert has now been identified by the United Nations Children's Fund (UNICEF) office in Tajikistan, who proceed with the review of legislation.

It is indicated that in 2020 the Ministries of Justice, Labour, Migration and Employment, Internal Affairs, Education and Science organized and conducted advanced training courses to improve the skills of the staff of the detention or restriction of freedom facilities.

Under the government Decree No. 387 of July 25, 2020, a programme for the rehabilitation and social reintegration of underage, who have served their sentence in detention or correctional facilities for the period from 2020 to 2024 was adopted to implement subparagraph 4 of paragraph 16 of the plan. This program is aimed at the rehabilitation and social reintegration of the underage, who served their sentences in the detention or correctional facilities following the international norms and standards on justice for children, which creates a basis for the formation and development of the inter-agency system for rehabilitation and social reintegration of children who served their sentences detention or correctional facilities. At the same time, the National Program on Prevention of Juvenile Delinquency for 2020-2025 was adopted by Decree No. 431 of the Government of the Republic of Tajikistan dated July 30, 2020. This program provides dignified treatment of minors, under which the rights and dignity of minors are respected, the needs of each minor are taken into account, and the reduction of juvenile delinquency is promoted.

- To strengthen the work of the psychologist for juvenile inmates, the Main Department of Criminal Sanctions will engage one specialist in this field on a contractual basis.

Monitoring the implementation of “National Plan for the implementation of the recommendations of the UN Committee against Torture for 2019-2022” in the interval of 2019-2020 has been prepared jointly by the Executive Office of the President of the Republic of Tajikistan and the Civil Society Coalition Against Torture and Impunity in Tajikistan.

How can the situation be improved? The only recommendation is - DO NOT KEEP SILENT!

Victims and their relatives - not to tolerate violence and inhuman treatment, make such cases public to protect their dignity.

Journalists and human rights defenders (CS) - provide professional assistance to victims, talk about problems.

The stateimpose a total ban on torture and the obligation to monitor and punish the perpetrators.
