Monitoring[1]: accession to the Optional Protocol is considered appropriate

It should be noted that the monitoring of the implementation progress of the National Action Plan to implement the recommendations of the UN Committee against Torture for 2019-2022 in the interval of 2019-2020 was prepared by the Executive Office of the President of the Republic of Tajikistan and the Civil Society Coalition against Torture and Impunity in Tajikistan. Its objective is to guide the implementation of legislation and law enforcement practices and freedom from torture, based on international standards of the right to freedom from torture.

According to the monitoring report, concerning the implementation of paragraph 21 of the plan, the Supreme Court and the Commissioner for Human Rights consider it appropriate to establish a working group to study the possibility of Tajikistan acceding to the Optional Protocol to the Convention against Torture.

- The Ministry of Justice notes that the adoption of this document creates several additional obligations for the member states. Some articles of the Additional Protocol do not meet the criteria of the Code of Criminal Execution of the Republic of Tajikistan. Analysis of the issue, in general, has shown that the procedure of accession to the Additional Protocol is purely technical, and its implementation requires several amendments and additions to the existing system and legislation. In addition, there is no unified position on this issue among the relevant ministries and agencies, and work in this direction continues," the report says.

Paragraph 22 of the plan is being implemented. On this issue, the necessary information on the recommendations and reports of the Republic of Tajikistan is regularly published on the websites of the Ministry of Foreign Affairs (www.mfa.tj), the Commissioner for Human Rights (www.ombudsman.tj), the Commissioner for the Rights of the Child (www.vhk.tj) and the Commission on ensuring the implementation of international obligations in the field of human rights under the Government of Tajikistan (www.khit.tj).

Monitoring the implementation of “National Plan for the implementation of the recommendations of the UN Committee against Torture for 2019-2022” in the interval of 2019-2020 has been prepared jointly by the Executive Office of the President of the Republic of Tajikistan and the Civil Society Coalition Against Torture and Impunity in Tajikistan.

How can the situation be improved? The only recommendation is - DO NOT KEEP SILENT!

Victims and their relatives - not to tolerate violence and inhuman treatment, make such cases public to protect their dignity.

Journalists and human rights defenders (CS) - provide professional assistance to victims, talk about problems.

The stateimpose a total ban on torture and the obligation to monitor and punish the perpetrators.
