Monitoring[1]: the monitoring mechanism is being improved
It should be noted that the monitoring of the implementation progress of the National Action Plan to implement the recommendations of the UN Committee against Torture for 2019-2022 in the interval of 2019-2020 was prepared by the Executive Office of the President of the Republic of Tajikistan and the Civil Society Coalition against Torture and Impunity in Tajikistan. Its objective is to guide the efforts to implement legislation and law enforcement practices and freedom from torture, based on international standards of the right to freedom from torture.
According to the monitoring report, regarding the implementation of paragraph 10 of the plan, the Commissioner for Human Rights monitoring team is working on improving the monitoring mechanism every year. In particular, in 2019, the said monitoring group conducted monitoring in 14 closed and partially closed institutions. In 2020, monitoring by the monitoring group in closed and partially closed institutions was limited due to the spread of COVID-19. Despite the restrictions, the staff of the Office of Commissioner for Human Rights - members of the monitoring group conducted monitoring in the correctional institutions YS 3/2, 3/8 and 3/5 of the Main Penitentiary Department of the Ministry of Justice, temporary detention facilities of Baljuvan district of Khatlon Region, Shugnan district of GBAO and Tajikabad Region, pre-trial detention centre YT9/3 and Main Penitentiary Departments of the Ministry of Justice in Khorog, GBAO (a total of 7).
Concerning the implementation of subparagraph 2 of paragraph 10 of the plan, the Ministry of Justice stresses that it supports its previous proposal to improve the draft agreement on cooperation between the Government of Tajikistan and the International Committee of the Red Cross based on the country's legislation and implement the issue of visits to penal institutions under the schedule. It should be noted that the official position of the mentioned committee on this proposal yet has not been expressed.
Monitoring the implementation of “National Plan for the implementation of the recommendations of the UN Committee against Torture for 2019-2022” in the interval of 2019-2020 has been prepared jointly by the Executive Office of the President of the Republic of Tajikistan and the Civil Society Coalition Against Torture and Impunity in Tajikistan.
How can the situation be improved? The only recommendation is - DO NOT KEEP SILENT!
Victims and their relatives - not to tolerate violence and inhuman treatment, make such cases public to protect their dignity.
Journalists and human rights defenders (CS) - provide professional assistance to victims, talk about problems.
The state – impose a total ban on torture and the obligation to monitor and punish the perpetrators.
